These Terms and Conditions govern your use of our website and the purchase of products from Cakes by Divya. We reserve the right to update these terms at any time without prior notice.

How do I place an order?

To help us assist you quickly, please share your event date, number of servings, budget, and any reference pictures or ideas / Invite that you may have for us to design the cake.

2. Products

All our baked goods are handmade and may vary slightly in appearance, size, and decoration from the images displayed on our website.

We make every effort to accurately describe our products; however, colors and presentation may differ due to screen settings and the handcrafted nature of our products.

3. Orders

• Full payment is required before an order is confirmed.
• Custom orders require approval and may have longer preparation times.
• Once production has begun, orders cannot be cancelled or modified.Any orders which requires modifications should be done 24 hours prior to the delivery…custom cakes modifications should be informed atleast 72 hours prior

• All orders placed online are scheduled for next day delivery with at least 24 hour time.For custom cakes, a pre-order of  minimum 4-5 days is required as all our cakes are baked fresh and made to order only. For urgent orders kindly contact us on whatsapp we will serve you if there is a possibility.

4. Pricing

All prices are listed in [AED] and include applicable taxes unless otherwise stated.

We reserve the right to change prices without prior notice. Price changes will not affect on the confirmed orders.

5. Payment

We accept secure online payments through approved payment providers.

Orders will only be processed once payment has been successfully received. You  can alternatively whatsapp us for payment through bank tramsfers

6. Pickup and Delivery

Customers are responsible for collecting orders at the agreed pickup time unless delivery has been arranged.

For deliveries:

• Delivery times are estimates and may vary due to traffic or unforeseen circumstances.
• Someone must be available at the delivery address to receive the order.
• We are not responsible for products left unattended after delivery.
• delivery charges will be calculated on the distance of the location. If u need delivery in other emirates kindly whatsapp us. 

7. Refunds and Cancellations

Due to the perishable nature of our products:

• Refunds are generally not available 
• If there is an issue with your order, please contact us within 30 minutes of delivery of receiving it with photographs where applicable.
• We will assess each case individually and may offer a replacement, store credit

8. Allergens

Our products may contain or come into contact with:

• Wheat (Gluten)
• Eggs
• Milk
• Soy
• Peanuts
• Tree Nuts
• Sesame

Although we follow good food handling practices, we cannot guarantee an allergen-free environment.

Customers with food allergies should contact us before placing an order.

9. Custom Cakes and Special Orders

For custom cakes and specialty items:

• Design approval is to be confirmed with the customer before production.
• Minor variations in decoration and color may occur.
• We reserve the right to make small substitutions where decorations are unavailable while maintaining the overall design and quality.

• kindly look out for wire and sticks in the custom cakes and kindly remove them before serving 

10. Storage

Our products are best enjoyed fresh.

Storage instructions provided with your order should be followed. We are not responsible for quality issues resulting from improper storage or handling after collection or delivery.

Brownies : Can be stored at room temperature for 2 days in air tight containers or refrigerated for 5 days Thaw for 30 minutes at room temperature before consuming or microwave for 15 secs.
Cookies : They can stay at a cool room temperature for 5-7 days.  Microwave 15 secs before consuming.
Cakes : Keep them refrigerated once received. Remove and thaw at a cool room temperature for 1hr before consuming. All cream cakes should be stored in the refrigerator and consumed within 2-3 days.
Tea cakes :  Can be stored in the refrigerator for 4-5 days

Orders & Payments, Delivery, Title Of Products & Risk Of Loss And Return Policy:

While we strive to provide accurate product and pricing information, pricing or typographical errors may occur. In the event that a product is listed at an incorrect price or with incorrect information due to an error in pricing or product information, we may, at our discretion, either contact you for instructions or cancel your order and notify you of such cancellation. We will have the right to modify the price of the product and contact you for further instructions using the e-mail address or telephone number provided by You during the time of registration, or cancel the order and notify you of such cancellation. In the event that we accept your order the same shall be debited to your credit card/bank account/paytm wallet, as may be opted by You. The payment may be processed prior to dispatch of the product that you have ordered. If we have to cancel the order after we have processed the payment, the said amount will be reversed back to you through the instrument from which payment was received.

Please note that there may be certain orders that we are unable to accept and must cancel. We reserve the right, at our sole discretion, to refuse or cancel any order for any reason. Some situations that may result in your order being cancelled shall include limitations on quantities available for purchase, inaccuracies or errors in product or pricing information, problems identified by our credit and fraud avoidance department or any defect regarding the quality of the product. We may also require additional verifications or information before accepting any order. We will contact you if all or any portion of your order is cancelled or if additional information is required to accept your order.

In case of requests for order cancellations, we reserve the right to accept or reject requests for order cancellations for any reason. A request for cancellation of order shall be valid based on the following scenarios:

Case 1: COD Payment mode:

Order can be cancelled until the invoice is generated ie. it can be cancelled if invoice is not generated and product has not been dispatched.

Case 2 : Online Payment

A request for cancellation of order shall be valid and accepted only if they are made within 24 (twenty four) hours of making the order on the Website. We will not be able to cancel orders that have already been processed or orders for which request for cancellation is made after the expiry of 24 (twenty hours) from making the order.

We have the full right to decide whether an order has been processed or not. The customer agrees not to dispute the decision made by us and accept our decision regarding the cancellation. In the event of cancellation of order by the customer we shall not refund the promotional voucher, if any used by the customer against such order.

Our fraud detection team constantly monitors the user’s account in order to avoid fraudulent accounts and transactions. Users with more than one account or availing referral vouchers fraudulently shall be liable for legal actions under law and we reserve the right to recover the cost of goods, collection charges and lawyer’s fees from persons using the Website fraudulently. We reserve the right to initiate legal proceedings against such persons for fraudulent use of the Website and any other unlawful acts or omissions in breach of these terms and conditions. In the event of detection of any fraudulent or declined transaction, prior to initiation of legal actions, we reserve the right to immediately delete such account and dishonour all past and pending orders without any liability. For the purpose of this clause, we shall owe no liability for any refunds.

Shipping of products will be done by the method indicated in the order. If for any reason WALSON decides to send the product using an alternate method, other than the one indicated in the order, you will not need to pay any additional charges for this. Title and risk of loss for any or all products ordered by you shall pass on to you upon WALSON shipment to the shipping carrier. Unauthorized Charges on your card:

If You see charges on Your credit/debit card for purchases made on the Website, but You never created an account or signed up, please check with Your family members or business colleagues authorized to make purchases on your behalf, to confirm that they haven't placed the order. If you're still unable to recognize the charge, please report the unauthorized purchase to your Bank to enable them begin an investigation.

Cancellation of Fraudulent Orders:

To provide a safe and secure shopping experience, we regularly monitor transactions for fraudulent activity. In the event of detecting any suspicious activity, WALSON reserves the right to cancel all past, pending and future orders without any liability. WALSON also reserves the right to refuse or cancel orders in scenarios like inaccuracies in pricing of product on website and stock unavailability. We may also require additional verifications or information before accepting any order. We will contact you if all or any portion of your order is cancelled or if additional information is required to accept your order. If your order is cancelled after your card has been charged, then the cancellation is accepted only if request is made within 24 (twenty four) hours of making the order on the Website. We will not be able to cancel orders that have already been processed or orders for which request for cancellation is made after the expiry of 24 (twenty hours) from making the order.

Any promotional voucher used for the cancelled orders shall not be refunded.

The customer may be considered fraudulent if any of the following scenarios are met:

Customer with a very high return rate;

Customer doesn't reply to the payment verification mail sent ;

Customer fails to produce adequate documents during the payment details verification;

Misuse of another customer's phone/email;

Customer uses invalid email and phone no.;

Overuse of a voucher code;

Use of a special voucher not tagged to the email ID used;

Customer returns the wrong product;

Customer refuses to pay for an order;

Customer is involved in the snatch and run for any order;

Invalid/Incomplete address escalated by FE; and

Cancellation of Bulk Orders,

WALSON may cancel any order that classify as 'Bulk Order' under certain criteria at any stage of the product delivery. An order can be classified as 'Bulk Order' if it meets with the below mentioned criteria, and any additional criteria as defined by WALSON or WALSON.in:

products ordered are not for self-consumption but for commercial resale;

multiple orders placed for same product at the same address, depending on the product category;

bulk quantity of the same product ordered;

invalid address given in order details; or

any malpractice used to place the order.

Any promotional voucher used for placing the 'Bulk Order' may not be refunded.

Process for Pilferage Claim

If a customer raises a complaint for partial item/partial order through Customer Care:

The customer is supposed to claim for pilferage within 48 hours of delivery failing which the claim will not be entertained;

An Email will be sent to customercare@KHUSHI IMPEXtravel.com seeking/providing following information:

Short description of the case (A few questions will be asked to help us understand the scenario);

The snapshots of the packet and other box (If any)(Try to cover the sides which look tampered/damaged as per the customer); and

The refund for prepaid orders will be done after investigation which usually requires 3-4 business days.

The process will include investigation with the concerned departments.

The customer may not be liable for a refund if he/she falls in any of the scenarios stated below:

Customer fails to provide adequate information about the case;

Customer fails to provide snapshots of the packet and box (if any);

If an opened delivery was received, pilferage claims must be made the same day; and

Customer must not dispose the packaging for 3-4 days post delivery. We might need to pick-up your packaging for investigation at our end.

This Agreement shall be subject to and construed in accordance with the laws of India and the Parties hereby submit to the exclusive jurisdiction of the courts of Mumbai.

Liability

WALSON shall only be liable for the actual and direct and any other losses suffered by you as a result of access or use of this Website, subject to the maximum limit of the amount paid by you for the purchase of the respective products from this Website. Notwithstanding anything contained elsewhere WALSON shall not at all be liable to you / third party for any direct and / or indirect damages, claims, losses including loss of profits, loss of business or indirect, consequential or punitive damages, whatsoever in connection with the provision or use of Information hereunder including the usage of this Website.

Termination

You or we may suspend or terminate your account or your use of this Website at any time, for any reason or for no reason. You are personally liable for any orders placed or charges incurred through your account prior to termination. We reserve the right to change, suspend, or discontinue all or any aspect of this Web Site at any time without notice.

Dispute Resolution

In the event of any disputes, differences or controversies between the Parties hereto, out of or in connection with the provisions of this Agreement, or any action taken hereunder, the Parties hereto shall thoroughly explore all possibilities for an amicable settlement. In case an amicable settlement cannot be reached, such disputes, differences or controversies shall be referred to arbitration in accordance with the provisions of the Arbitration and Conciliation Act, 1996 including any amendment or re-enactment thereof. The proceedings of such arbitration shall be conducted in English language and the venue of such arbitration shall be Mumbai. The award of such arbitration shall be final and binding upon the Parties hereto. All notices, demands or other communications required or permitted to be given or made under or in connection with this Agreement shall be in writing and shall be sufficiently given or made (i) if delivered by hand or (ii) sent by pre-paid registered post addressed to WALSON.
